Introduction

Welcome to our platform. These Terms and Conditions ("Terms") govern your use of the platform and participation in any property sweepstakes or raffle ("Competition") offered through our site. By creating an account or entering a Competition, you agree to be bound by these Terms. If you do not agree, you should not use the platform or enter any Competitions. Each Competition may also have additional Official Rules or specific terms on its listing page; if there is any conflict between those rules and these Terms, the specific Competition rules will prevail. All Competitions are subject to applicable federal, state, and local laws and regulations, and are void where prohibited or restricted by law. We reserve the right to modify these Terms at any time, and will update the "Last Updated" date accordingly. Your continued use of the platform after changes indicates acceptance of the revised Terms.

Eligibility

Age Requirement: You must be at least 18 years old (or the age of legal majority in your state of residence) to create an account or participate in any property raffle Competition on our platform. By registering, you confirm that you meet this age requirement.

Residence: Our Competitions are currently open to legal residents of the United States. However, entry may be void in certain states or jurisdictions where such raffles are prohibited or where we do not operate. It is your responsibility to comply with your local laws. We specifically launch initially in Colorado, and our operations are designed to comply with Colorado state law; we intend to generalize compliance across all U.S. states.

One Account Per Person: You may only create and use one account on the platform. Accounts are non-transferable. Using multiple accounts or false information to enter a Competition is prohibited and may result in disqualification.

Ineligible Parties: Employees, officers, and agents of the Company, the property seller of a particular Competition, are not eligible to participate in that Competition. We reserve the right to disqualify any entrant if we determine in our sole discretion that they do not meet the eligibility requirements or have violated these Terms.

Account Registration

To participate, you must register an account with minimal information. During registration, we will ask for your full name, email address, and confirmation that you are of legal age (18+). We do not require extensive personal details to sign up – just the basics needed to identify you and contact you. You agree to provide accurate and current information. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. If you suspect any unauthorized use of your account, notify us immediately. We may suspend or terminate accounts that we believe are compromised or violating these Terms.

How to Enter a Property Sweepstakes

Each property Competition on our platform provides an opportunity to win real estate (the "Property") as a prize. No purchase, payment, or other financial contribution is necessary to enter or win a sweepstakes. Every Competition will offer a free alternate method of entry (AMOE) for those who wish to participate without buying tickets, ensuring compliance with sweepstakes laws. For example, you may enter for free by mailing in your entry information. All entries, whether obtained via purchase or via the free method, have an equal chance of winning; purchasing tickets will not increase your luck in terms of the fairness of the draw (though buying more tickets does give you more entries, each entry has equal odds).

To enter a Competition, follow these general steps:

  1. Account Creation: First, create a free user account on our platform (or log in to your existing account).
  2. Select a Competition: Choose the active property raffle you are interested in. Each Competition page will describe the property, the ticket price, the minimum sale price, the entry deadline, and any specific rules.
  3. Obtain Entries: You can obtain entries either by purchasing tickets or using the free entry method. If purchasing, select the number of tickets you wish to buy and complete the checkout process. If entering for free, follow the provided instructions (such as sending a postcard with your name, contact info, and the specific Competition name). We limit one free entry per person per Competition (unless otherwise stated in the Competition rules) to ensure fairness.
  4. Confirm Entry: Upon successful purchase, you will receive a confirmation (receipt) by email along with your ticket numbers, and your entries will be recorded in your account. If you enter via the free method, your entry will be recorded in the system once received and processed; you may not receive an email receipt for free entries. All entries must be received before the Competition's closing deadline. Late entries (including mailed entries that arrive after the deadline) will be disqualified.

By entering, you agree to abide by these Terms and the Official Rules of the specific Competition. Entries that do not comply with the instructions or that are incomplete, illegible, or fraudulent will be void. We are not responsible for lost, late, misdirected, or damaged entries (including any mail-in entries that get lost or delayed). Automated or bulk entries (apart from approved bulk ticket purchases through our interface) are prohibited.

Payments and Fees

If you choose to purchase entries (tickets) for a Competition, payment will be processed through our third-party payment processor (currently Stripe). All major credit/debit cards are accepted via Stripe’s secure checkout. We do not collect or store your full payment card information on our servers – your card details are handled securely by Stripe in accordance with their policies. Once your payment is processed, we only receive confirmation of the transaction and basic details (like your name, email, and the amount). The Company never sees or retains your complete credit card number or security code. All payments are processed in U.S. dollars (USD). If you use a non-U.S. card or account, you are responsible for any currency exchange fees or international transaction fees that your bank might charge.

Entry Fee: Each Competition will state the price per entry (ticket). You may purchase as many tickets as you like (subject to any limits in the specific Competition rules). The Entry Fee for tickets helps fund the prize and associated costs. However, remember that purchase is optional since a free entry route is available.

Payment Confirmation: When your payment is successful, we will email you a receipt confirming the number of entries you have and assign ticket numbers to your entries. These will also be visible in your online account. If your payment fails or is declined, you will not receive entries. We recommend ensuring your payment information is accurate and that you have sufficient funds or credit.

Fees and Charges: The ticket prices are inclusive of any platform service fees. You will be responsible for your own internet or data charges for accessing our service. The Company is not responsible for any fees charged by your bank or card (such as overdraft fees or interest).

Sweepstakes Period and Closing Date

Each property Competition will have a clearly stated start date and closing date (the entry deadline). The seller of the property typically decides how long the raffle will run, with a minimum run time of one (1) month for any Competition. The exact closing date and time will be posted on the Competition page. We reserve the right to extend the closing date at our discretion (for example, if more time is needed to reach the ticket sales goal, or due to marketing considerations), but any extension or change will be communicated on the Competition page and, if significant, via email to existing entrants.

After the closing date, no further entries will be accepted. The drawing to determine the winner (and any runners-up or alternates) will take place no later than 7 calendar days after the draw date stated in the Competition details, or on the specific draw date stated in the Competition details. All drawings are conducted randomly, using either an electronic random draw system or an independent third-party draw service to ensure fairness. We may engage a third-party auditor or raffle service to oversee the draw for integrity.

Fundraising Goal and Ticket Sales Threshold

Each property Competition will have a minimum threshold that must be met for the grand prize (the Property) to be awarded. This threshold— based on the total funds needed to cover the seller’s minimum reserve price—will be disclosed on the specific Competition page (e.g., “a minimum of $X must be raised”).

The seller reserves the right, at their sole discretion, to proceed with awarding the property even if the minimum goal is not reached. In such a case, the Competition will still move forward with a drawing, and the winner will receive the property as the grand prize, regardless of whether the original ticket sales threshold was fully met.

If the seller does not elect to proceed and the fundraising threshold is not met by the closing date, then the Competition will be considered unsuccessful and the property will not be sold or transferred via the sweepstakes. In that event, the following options will apply based on the type of entry selected at purchase:

  1. Refund-Eligible Entries: Participants who selected a standard entry (eligible for refund if the sweepstakes fails) will be notified that the threshold was not met and given a choice: Receive a full refund of the ticket price paid; or Apply their purchased entries as a credit toward another active property Competition on our platform. We will provide instructions and 7 days to make this selection. If you do not respond within the stated timeframe, the default action will be to apply purchased entries as a credit toward another active property Competition on our property. If a promotional voucher or discount was used, the refund will reflect the actual amount paid.
  2. Donation-Authorized Entries: Participants who selected the “Donate if Not Drawn” option at checkout will not receive a refund. Instead, the funds from their entries will be transferred to a designated 501(c)(3) charitable organization chosen by the platform. This contribution will be made by the Company and not directly by the entrant. As such, the entrant will not receive a tax receipt.
  3. Non-Refundable / Double-Entry Participants: Participants who selected the “Double My Entries / No Refund” option agree to waive their right to a refund if the sweepstakes does not result in a draw. In exchange, these participants receive twice the number of entries into the sweepstakes. If the sweepstakes is unsuccessful, the Company retains those funds to support future sweepstakes operations. These entries will not be refunded or rolled over unless otherwise disclosed.

Free Entries: Participants who entered via the free method will simply be notified that the Competition did not result in a prize, and no refund or compensation is due, as no payment was made.

Property Ownership: If the sweepstakes fails to meet the minimum threshold, the seller retains full ownership of the property. Neither the Company nor any entrants will have any claim to the property.

This policy ensures a sufficient number of entries are sold to make awarding the property feasible. It also gives participants agency to choose how their entry is handled in the event of an unsuccessful campaign. If the total goal is met by the closing date, the Competition proceeds to a drawing to determine the winner of the property. In some cases, even if the threshold is not fully met, the Company may at its discretion award an alternative prize (e.g., a percentage of funds raised in cash). Such exceptions will be clearly disclosed on the Competition’s individual listing.

Winner Selection and Notification

After the Competition closes (and assuming any minimum threshold was met), we will conduct a random drawing to select the winner. The selection process is random and does not discriminate – each entry (ticket) has an equal chance of being drawn. We may use a certified random number generator or an independent sweepstakes administrator to ensure fairness.

Notification: The potential winner will be notified by the contact information associated with their account. We will notify the winner via email (to the email address provided at registration or ticket purchase) and by telephone if a phone number was provided or can be obtained. Notification will be sent within 7 days of the drawing. The winner will be given instructions on how to claim the prize. It is very important that you provide a valid email address and check it regularly, including spam/junk folders, after the Competition ends. We are not responsible if you miss the notification email or it gets filtered out.

The potential winner is required to respond within 14 days of the Company’s first notification to confirm they wish to accept the prize and to begin the winner verification process. If a notified winner does not respond in time or cannot be contacted, the prize will be forfeited. In such cases, no runner-up or alternate winner will be selected. The unclaimed price will revert to FulHouse (the Company) and may retained, donated, or otherwise disposed of at the Company’s sole discretion.

If the potential winner is found to be ineligible or disqualified for any reason, they will forfeit the prize, and the Company will conduct a new random drawing to select the winner. This process will continue until an eligible winner is confirmed, or if no alternates remain, the Company reserve the right to handle the prize at our discretion.

Winner Verification: Before confirming a winner, we will verify that the person is eligible and complied with the rules. The winner will be required to sign and return certain documents to formally claim the prize. This includes an affidavit of eligibility, a liability waiver, and a publicity release (where permitted by law) which allows us to announce your name, general location, and likeness as the winner. We will also require proof of identity and age. For example, the winner may need to provide a copy of a government-issued ID (such as a driver's license or passport) to confirm they are the account holder and over 18. In some cases, we might ask for additional proof of address or other verification to prevent fraud. Additional documentation like proof of eligibility to own property or complete a real estate transfer might be needed.

We may also perform a background check on the potential winner for any reason we deem necessary (for instance, to ensure the winner does not have any disqualifying criminal history that would prevent legally transferring the property, or that awarding the prize to them would not violate any law). By entering, you consent to such background checks if required. If any legal impediment is found that would bar us from awarding you the property (for example, if you are on a government sanctions list, or if owning the property would violate local laws due to the winner's status), we may disqualify that winner and move to an alternate.

Once verification is successfully completed, we will coordinate the prize transfer.

Prize (Property) Delivery and Winner’s Responsibilities

The Prize Property: The grand prize for each property Competition is the real estate property described on the Competition page (the "Property"), awarded in "as-is" condition. "As-is" means the property will be transferred in the condition as shown and described, with no additional improvements or warranties from the seller or the Company. We require sellers to provide accurate and up-to-date information about the property, including recent photographs and a video tour, before we list it on our site, and the Company reviews this material to ensure it meets our quality standards. However, the Company does not guarantee that the property will be free of defects or exactly as portrayed; there may be normal wear-and-tear or changes. The winner accepts the Property in its current condition as of transfer. The Property will come either free and clear of any mortgages, liens, or other encumbrances, or subject to any disclosed conditions in the Competition listing. (The seller must agree to deliver a clear title so that the winner receives ownership without outstanding debts on the property.) The prize includes the real estate itself; unless stated, it does not automatically include furniture, vehicles, or other personal property, except as explicitly described in the Competition details. Some Competitions might offer additional elements like furnishings, cash bonuses, or other perks – refer to the specific listing for what is included (e.g., "fully furnished" or a cash alternative option).

Prize Transfer Process: The transfer of the Property will be handled through a standard real estate transaction process after the winner is confirmed. The winner will need to sign a sale/transfer contract and any other documents required to legally transfer ownership from the seller to the winner. The Company and the seller will work with the winner to complete this process, which will likely involve a title or escrow company. The winner agrees to cooperate fully and promptly in this process. We expect the transfer to be completed within a reasonable timeframe (for example, within a few weels of the drawing). If the winner unreasonably delays or refuses to sign the necessary documents or fails to cooperate, they may forfeit the prize and an alternate winner could be chosen, so please only enter if you are prepared to follow through should you win.

Any costs associated with the transfer of the property title (such as escrow fees, title insurance, standard closing costs) will either be covered by the Company and/or seller, or will be disclosed in the Competition rules if the winner is expected to cover them. We strive to make the handover as smooth as possible. Unless otherwise noted, the winner is responsible for any property taxes, insurance, homeowner association fees, utilities, maintenance, and all other costs of ownership from the date of transfer onward. In other words, once the house is yours, you assume all the usual responsibilities of a homeowner.

No Cash Alternative: Our standard policy is that the Property is the prize and there is no cash or alternate prize You cannot "exchange" the house for money or another prize from us, and you can’t request a different house. In some cases, and at the sole discretion of the Company, the Company may offer the winner up to 50% of the property value in cash as determined by a third-party appraisal in exchange for the Property. In these cases, the winner is responsible for attaining a 3rd party appraisal to exchange the Property for cash.

Additionally, prizes are not transferable, you as the confirmed winner have to take ownership. We will not transfer the prize to a third party or allow you to assign it to someone else, except in the unfortunate situation where a winner passes away before transfer; in that case, we will work with the winner’s estate according to law.

Winner's Responsibility for Taxes and Fees

All federal, state, and local taxes associated with winning the Property are the sole responsibility of the winner. Winning a house through a sweepstakes is treated as winning a prize, which under U.S. tax law means it is typically considered taxable income. The winner will likely be required to pay income taxes on the approximate fair market value of the property. This could be a substantial tax liability, so entrants should be aware of this. The Company will provide the winner with the necessary tax forms (such as an IRS Form 1099) reporting the value of the prize, and the winner may be required to fill out IRS Form W-9 (for U.S. residents) or other tax documents as needed.

Aside from taxes, the winner is also responsible for any other costs tied to the prize after transfer. This includes property insurance, ongoing utilities, property maintenance, and any applicable homeowner association dues, etc., once you own the home. If the property is in not your state, you might also incur costs to travel or relocate, which is your responsibility. We do not provide additional travel or relocation expenses in our standard prize (unless the Competition specifically offers something like a moving stipend, which would be stated explicitly).

In summary, we cover the prize property itself, but the winner covers taxes and long-term costs of owning the property. We strongly advise winners to consult a financial or tax advisor to plan for the tax implications of the prize.

Refund Policy

All ticket purchases are final and non-refundable, except under the limited circumstance where the property sweepstakes does not successfully reach its required ticket sales threshold and the seller does not elect to proceed (as explained above). In that scenario, paid entrants are eligible for a refund of their ticket purchase (or a credit transfer to another Competition), unless they opted into a nonrefundable entry type at checkout.

At the time of purchase, entrants may select from one of the following entry options:

  1. Standard Entry (Refundable): If the Competition does not meet its ticket sales goal and the seller chooses not to proceed with awarding the property, you will be eligible for a full refund or transfer of your entry to another active sweepstakes.
  2. Donation-Authorized Entry (Nonrefundable): If you select this option, you authorize us to donate your entry fee to a designated 501(c)(3) charitable organization if the sweepstakes does not meet its minimum goal and is not awarded. In such cases, no refund will be issued. FulHouse, not the entrant, will be the donor of record and may claim the charitable tax deduction. Entrants who choose this option will not receive a donation receipt or any tax benefit.
  3. Double Entry / No Refund Option: If you select this option, you agree to waive any right to a refund if the Competition is not successful. In exchange, you receive double the number of entries into the sweepstakes. These funds will be retained by FulHouse to support future sweepstakes and platform operations. No refund or donation credit will be issued for this entry type, even if the sweepstakes does not result in a draw.

Outside of the scenarios above, we do not offer refunds simply because you did not win or changed your mind. By purchasing entries, you understand that you are buying a chance to win—not a product or service that can be returned.

If a refund is issued (due to a canceled Competition or other extraordinary reason approved by us), it will be processed back to the original payment method whenever possible. If the original payment method is unavailable or expired, we will contact you to make alternative arrangements (e.g., issuing a check). Refunds will typically be processed within a reasonable time after the Competition is canceled or the determination that a refund is due.

In the event of any fraudulent payment or if a chargeback/dispute is raised on a ticket purchase, we reserve the right to invalidate the associated entries. If you have a payment dispute, please contact our customer support to resolve it rather than initiating a chargeback through your bank, to avoid confusion.

User Conduct and Prohibited Activities

When using our platform, you agree to conduct yourself lawfully and respectfully. You must not:

  • Cheat or Tamper: Do not engage in any fraudulent, collusive, or illegal conduct in relation to the Competitions. This includes not tampering with the entry process or the random drawing, not exploiting any loopholes, and not using automated programs (bots) to enter. Any attempt to hack, undermine, or interfere with the platform’s legitimate operation will result in disqualification and potential legal action.
  • Misrepresent Information: You must not provide false information during registration or entry. Do not impersonate anyone or attempt to claim a prize using someone else’s identity. Winners must prove their identity matches the account and entry drawn. Any false identity or use of disposable emails purely to game the system is prohibited.
  • Sell or Trade Tickets/Entries: Entries (tickets) have no cash value and are only valid for the person who entered. You may not resell your entries or trade them. Any attempt to transfer entries to another person outside of the official credit transfer (when a Competition is canceled) is not allowed. Similarly, if you receive a free entry via a promotion or as a gift from the platform, you cannot exchange it for money.
  • Multiple Accounts: As mentioned, creating multiple accounts to gain more free entries or take advantage of new-user promotions is against the rules. If we detect multiple accounts controlled by the same individual, we may merge or terminate those accounts and void any associated entries.
  • Inappropriate Content: If our platform allows any user-generated content (such as comments, reviews, or a community forum), you must not post anything illegal, hateful, harassing, or otherwise objectionable. We may remove content and/or ban users for such behavior. (Currently, our platform’s interaction is limited to purchasing entries and contacting support, so this mainly applies in contexts like social media interactions.)
  • Compliance with Laws: You are responsible for complying with all applicable laws in connection with your participation. For example, do not attempt to participate if you are in a jurisdiction where the sweepstakes is not allowed. Do not engage in money laundering or any misuse of the payment system. We will report any suspected unlawful activity to the authorities.

Violation of any of the above rules can result in immediate disqualification from a Competition (with no refund), forfeiture of any prize, and suspension or termination of your account. The Company’s decision on whether a violation occurred is final. We also reserve the right to refuse entry or ban any person from our platform for any reason, especially to uphold the integrity of the Competitions.

Disclaimers

No Guarantee of Winning or of Property Value: Your chances of winning depend on the number of entries received; there is no guarantee that purchasing more tickets will result in winning. The Company makes no guarantee regarding the future value of the prize property, rental income, or any potential resale value. Real estate market conditions can change, and the Company is not providing any investment advice.

As-Is Property and No Warranties: The Company and the property seller make no express or implied warranties or guarantees about the condition, fitness, or title of the property beyond what is stated. The property is offered "as is" and the winner assumes all responsibility for it upon transfer. To the fullest extent permitted by law, we disclaim any implied warranties (such as merchantability or fitness for a particular purpose) regarding the prize. That said, the seller is obligated to disclose any known problems as required by law, and the Company strives to vet properties for major issues. But neither the Company nor seller will be liable for any defects or issues discovered after the transfer.

Use of Platform: We provide our platform and services on an "as available" basis. While we aim for a smooth user experience, we do not warrant that the website will be uninterrupted or error-free. Technical malfunctions or maintenance outages can occur. We are not responsible for any technical problems or delays, including those that may temporarily prevent entry purchases or submissions. In the event of any technical malfunction that significantly affects a Competition (such as the drawing process or entry submissions), we reserve the right to modify, cancel, or postpone the Competition as appropriate.

Third-Party Services: We rely on third-party services for certain functions (e.g., Stripe for payments, email providers for communications, random draw services, etc.). While we choose reputable providers, we are not responsible for the acts or omissions of third parties. For example, if Stripe’s service is down or if an email provider blocks our emails, those are outside our control.

Data Security and Phishing Disclaimer: We take reasonable measures to protect the security of your personal and payment information and maintain appropriate safeguards to help prevent unauthorized access. However, by using the platform, you acknowledge and agree that no system is completely immune to cybersecurity risks. FulHouse is not responsible for any losses, damages, or harm that may result from unauthorized access to your account due to phishing attacks, third-party data breaches, malware, or other forms of cyber intrusion beyond our control. We will never email you or message you requesting you to re-enter your credit card information or personal login credentials. If you receive a suspicious message claiming to be from us, do not click any links or provide any sensitive information. Instead, please forward the message to phishing@fulhouse.com (or designated email) and contact our support team. By using the platform, you agree that you are solely responsible for safeguarding your login information and monitoring your account for any suspicious activity.

Limitation of Liability

By participating in our Competitions or using our platform, you agree that the Company, its owners, directors, employees, affiliates, and agents (collectively, the "Released Parties") are not liable for:

  • Any injuries, losses, or damages of any kind arising from participation in a Competition or acceptance, possession, or use of any prize (including any travel or activities related to winning or using the property). For example, if you win a house and then injure yourself in moving in, or you experience any loss related to owning it, we are not responsible.
  • Financial losses or missed opportunities, such as if you spend money on tickets and do not win, or if the prize house has costs associated with it.
  • Any incidental, consequential, or indirect damages even if we have been advised of the possibility of such damages. Some states do not allow the exclusion of such damages, so this clause may not apply fully to you. In such states, liability is limited to the maximum extent permitted by law.
  • Disputes between you and any third party (for example, between you and the property seller outside of our platform’s responsibilities, or between you and other entrants). The Company’s role is to facilitate the sweepstakes and coordinate the prize; the actual real estate transfer is ultimately a transaction between the seller and the winner. We will help, but we do not assume liability for the seller’s obligations beyond our reasonable control.
  • Any issues arising from circumstances beyond our control, such as natural disasters, acts of God, war, pandemic, government restrictions, or other force majeure events that might force us to cancel or modify a Competition.

Our total liability to any participant for any claim arising out of or relating to these Terms or a Competition will not exceed the amount of money the participant has paid to us for entries (if any), or if the claim involves a prize winner, the value of the prize. We do not exclude or limit liability for any matter that cannot be excluded by law (such as personal injury caused by our gross negligence, or fraud).

Indemnification

You agree to indemnify and hold harmless the Company and its Released Parties from and against any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the platform, or your violation of any law or third-party rights. For example, if you provide false information, or if you somehow cause damage and a third party sues us because of something you did, you may be responsible for those costs.

Dispute Resolution and Arbitration

Any disputes or claims arising out of or relating to these Terms, our platform, or any Competition shall be resolved through binding arbitration on an individual basis, rather than in court, to the maximum extent permitted by law. By using the platform or entering a Competition, you and the Company agree to waive any right to a trial by jury or to participate in a class action lawsuit or class-wide arbitration. This means:

Arbitration: If a dispute arises, either party may initiate arbitration proceedings with a neutral arbitrator under the rules of a recognized arbitration organization (for example, the American Arbitration Association) in effect at that time. Arbitration is a private process where disputes are resolved by an arbitrator rather than a judge. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Individual Basis: All claims must be brought in the parties’ individual capacity, not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator shall not consolidate the claims of multiple individuals or preside over any form of a representative or class proceeding.

Exceptions: We both retain the right to bring an individual action in small claims court for qualifying claims, and the right to seek injunctive or equitable relief in a court of law for certain urgent matters (like intellectual property infringement or unauthorized access to our systems). Also, if a law prohibits arbitration of certain claims or allows you a right to opt out of arbitration, those laws will apply. You have the right to consult an attorney about your rights. If you wish to opt-out of the arbitration agreement, you must contact us in writing within 30 days of agreeing to these Terms, stating your intention to opt out of this arbitration clause (providing your account information for identification).

Arbitration Procedure and Venue: The arbitration will be conducted in English and, unless otherwise required by law, will take place in a location in Colorado or another mutually agreeable location. If you are an individual consumer using the platform for personal use, any required arbitration fees and your share of arbitrator compensation will be limited as per the consumer arbitration rules (we will provide more details on request or in the specific rules). Each party is responsible for their own attorneys’ fees, unless the arbitrator awards fees in accordance with applicable law.

This arbitration agreement is governed by the Federal Arbitration Act (FAA) and evidences a transaction in interstate commerce. If any portion of this arbitration clause is found unenforceable, it shall be severed, and the remainder shall remain in full force, except that if the class action waiver is found unenforceable, this entire arbitration section shall be void.

Governing Law and Jurisdiction

These Terms and any disputes relating to them or any Competitions will be governed by the laws of the State of Delaware, without regard to its conflict of law principles, and by applicable federal law (for instance, federal sweepstakes and lottery regulations). By using the platform, you agree that Delaware law governs our operations and your use,. Subject to the arbitration clause above, for any legal proceedings that are permitted to happen in court, you agree that they will be brought in the state or federal courts located in the State of Delaware, and you consent to the jurisdiction of those courts.

We recognize that our platform will operate across multiple states, and we aim to comply with the laws of all states in which we do business. If any provision of these Terms is found to be invalid or unenforceable under the law of a particular jurisdiction, that provision shall be interpreted in a manner to make it valid, or if that’s not possible, it shall be deemed severed from these Terms without affecting the validity of the remaining Terms.

Changes to Terms and Termination

Continued use of the platform after changes are made constitutes acceptance of the new Terms.

We reserve the right to terminate or suspend your account or access to the platform at any time, for any reason (including violation of these Terms or any fraudulent activity). If your account is terminated, you will lose access to any entries or upcoming Competitions you entered; however, any entries you made before termination remain valid unless we terminated the account for serious cause (like fraud). In that case, we may void your entries to protect the integrity of the Competition. We also reserve the right to cancel any Competition or remove any property listing at any time, for reasons including but not limited to fraud, legal concerns, or inability of the seller to complete the transaction. If we cancel a Competition after tickets have been sold, we will issue appropriate refunds to entrants as outlined above.
